مقدّمة اتفاقية الاستخدام:

متجرنا الالكتروني يرحّب بكم ويبلغكم بأنكم سوف تجدون أدناه الشروط والأحكام المُنظّمة لاستخدامكم لهذا المتجر وكافة الآثار القانونية التي تنتج عن إستخدامكم لخدمات المتجر عبر الشبكة العنكبوتية عبر هذه المنصة الالكترونية، حيث أن استخدام أي شخصٍ كان للمتجر سواءً كان مستهلكاً لخدمة أو لمنتج المتجر أو غير ذلك فإن هذا موافقة وقبول منه وهو بكامل أهليته المعتبرة شرعاً ونظاماً وقانوناً لكافة مواد وأحكام هذه الاتفاقية وهو تأكيد لالتزامكم بأنظمتها ولما ذُكر فيها، وتسري هذه الاتفاقية على جميع أنواع التعامل بين المستهلك وبين. وتعتبر هذه الاتفاقية سارية المفعول ونافذة بمجرد قيامكم بالموافقة عليها والبدء في التسجيل بالمتجر بموجب المادة العاشرة من نظام التعاملات الإلكترونية السعودي.

المادة الأولى - المقدّمة والتعريفات:

يعتبر التمهيد أعلاه جزءاً لا يتجزأ من هذه الاتفاقية ، كما تجدون أدناه الدلالات والتعريفات للعبارات الرئيسية المستهلكة في هذه الاتفاقية :

1- ( المتجر ) ويشمل هذا التعريف كافة أشكال المتجر على الشبكة العنكبوتية، سواءً كانت تطبيق إلكتروني، أو موقع الكتروني على الشبكة العنكبوتية، أو محل تجاري.

2- ( المستهلك) الشخص الذي يتعامل بالتجارة الإلكترونية رغبةً في الحصول على المنتجات أو الخدمات التي يوفرها من المتجر عبر منصته الالكترونية.

3- ( الاتفاقية ) يقصَد بهذه العبارة شروط وأحكام هذه الاتفاقية، والتي تحكم وتنظّم العلاقة فيما بين أطراف هذه الاتفاقية.

المادة الثانية - أهلية المستهلك القانونية:

1- يقر المستهلك بأنه ذا أهلية قانونية معتبرة شرعاً ونظاماً للتعامل مع المتجر، أو أن عمره لا يقل عن ثمانية عشرة عاماً.

2- يوافق المستهلك بأنه في حال مخالفته لهذه المادة، فإنه يتحمّل تبعات هذه المخالفة أمام الغير.

المادة الثالثة - طبيعة التزام:

1- إن التزام المتجر تجاه المستهلكين أو المستهلكين هو توفير ( الخدمة أو المنتج ) .

2- قد يوفّر المتجر خدمات أخرى كخدمات ما بعد البيع أو غيرها من الخدمات ذات العلاقة، وذلك يعود لطبيعة ونوع ( الخدمة أو المنتج ) المطلوبة من المستهلك.

المادة الرابعة - ضوابط استخدام :

1- يلتزم المستهلك باستخدام المنصة الالكترونية الخاصة بالمتجر بما يتّفق مع الآداب العامة والأنظمة المعمول بها في المملكة العربية السعودية.

2- يلتزم المستهلك عند شرائه لخدمة أو منتج من هذا المتجر ألا يستخدم هذه الخدمة أو المنتج بما يخالف الآداب العامة والأنظمة المعمول بها في المملكة العربية السعودية.

المادة الخامسة - الحسابات والتزامات التسجيل:

فور التقدم بطلب الانضمام إلى عضوية في هذا المتجر كمستخدم تكون ملتزماً بالإفصاح عن معلومات محددة واختيار اسم مستخدم وكلمة مرور سرية لاستعمالها عند الولوج لخدمات المتجر. وبذلك تكون قد وافقت على:

1- أن تكون مسؤولاً عن المحافظة على سرية معلومات حسابك وسرية كلمة المرور ، وتكون بذلك موافقاً على إعلام هذا المتجر حالاً بأي استخدام غير مفوض به لمعلومات حسابك لدى المتجر أو أي اختراق آخر لمعلوماتك السرية.

2- لن يكون المتجر بأي حال من الأحوال مسؤولاً عن أي خسارة قد تلحق بك بشكل مباشر أو غير مباشر معنويا أو ماديا نتيجة كشف معلومات اسم المستهلك أو كلمة الدخول.

3- أنت تلتزم باستخدام حسابك أو عضويتك لدى المتجر بنفسك، حيث أنك مسؤولاً عنه مسؤولية كاملة، وفي حال استخدام غيرك له فهذه قرينة على أنك قد فوّضته باستخدام المتجر باسمك ولحسابك.

4- أنت تلتزم عند استخدام المتجر أن تستخدمها بكل جدية ومصداقية.

5- أنت تلتزم بالإفصاح عن معلومات حقيقية وصحيحة ومحدثة و كاملة وقانونية عن نفسك حسبما هو مطلوب أثناء التسجيل لدى المتجر وتلتزم بتحديث بياناتك في تغييرها في الواقع أو في حال الحاجة إلى ذلك.

6- إن متجرنا يلتزم بالتعامل مع معلوماتك الشخصية وعناوين الاتصال بك بسريّة تامة.

7- إذا تبيّن للمتجر بأنك أفصحت عن معلومات غير حقيقية أو غير صحيحة أو غير راهنة أو غير كاملة أو غير قانونية او مخالفة لما جاء في اتفاقية الاستخدام، فإن المتجر يمتلك الحق في وقف أو تجميد أو إلغاء عضويتك أو متجرك وحسابك في المنصة، وذلك دون إلحاق الأضرار بحقوق المتجر الأخرى ووسائلها المشروعة في استرداد حقوقها وحماية باقي المستهلكين.

8- في حالة عدم الالتزام بأي مما ورد أعلاه فإن لإدارة المتجر الحق في إيقاف أو إلغاء متجرك أو عضويتك أو حجبك من الولوج لخدمات المتجر مرة أخرى.

المادة السادسة - الاتصالات الإلكترونية ووسائل التواصل الرسمية:

1- يوافق أطراف هذه الاتفاقية على أن التواصل يتم عبر البريد الإلكتروني المسجّل في المنصّة.

2- يوافق المستهلك على أن جميع الاتفاقيات والإعلانات والبيانات والاتصالات الأخرى التي تزود بها الكترونياً تقوم مقام مثيلاتها المكتوبة ، وهي حجة قائمة بذاتها ، في تلبية الاحتياجات النظامية والشرعية.

3- يوافق المستهلك على إمكانية التواصل معه وتبليغه بأي أحكام تخص هذه الاتفاقية أو تخص التعامل معه من خلال قيام إدارة المتجر ببث رسائل عامة ترد إلى كافة المستهلكين أو إلى مستخدمين محددين للمتجر

المادة السابعة - التعديلات على إتفاقية الإستخدام والرسوم:

1- في حال إلغاء أي مادة واردة أو بند ورد في ھذه الاتفاقیة أو أنّ ھناك أي مادة واردة أو أي بند ورد في ھذه الاتفاقیة لم یعد نافذًا، فإن مثل ھذا الأمر لا يلغي صلاحية باقي المواد والبنود والقواعد والأحكام الواردة في ھذه الاتفاقية وتظل سارية حتى إشعار آخر من إدارة المتجر

2- ھذه الاتفاقية - والتي تعدل بين حين وآخر بحسب مقتضى الحال - تُشكّل آلیة العمل والتفاھم والاتفاق بین (المستهلك) و( المتجر)

3- قد يفرض المتجر رسومًا على بعض المستهلكين وذلك يعتمد على العروض أو المنتجات أو الخدمات التي يطلبونها أو ما تفرضه الدولة من رسوم أو ضرائب على طبيعة المنتج أو الخدمة.

4- يحتفظ المتجر بحقه في إضافة أو زيادة أو خفض أو خصم أي رسوم أو نفقات بموجب مواد وبنود وأحكام إتفاقية الإستخدام ، على أي من المستهلكين أي كان سبب تسجيلهم.

المادة الثامنة – خدمات الدفع والسداد للمتاجر في المتجر

1- يوفّر المتجر عبر شركائها نظام الدفع والسداد في المتجر فيمكن أن يتم عبر الانترنت كليا من خلال خيارات الدفع المتوفرة على المتجر أو من خلال أي طريقة دفع يوفرها المتجر من حين لآخر.

2- يلتزم المتجر بتحديد سعر الخدمة أو المنتج الذي يقوم بعرضه في متجره وفقاً للقيمة السوقية المتعارف عليها.

3- يلتزم المتجر بتوفير فواتير وسندات قبض وسندات استلام لجميع المبالغ والأرباح التي تنشأ في متجره، ويلتزم بأن يعطي المستهلك فاتورة شرائه لخدمة أو منتج

4- يلتزم المتجر بتوفير المواصفات المحاسبية المتعارف عليها في متجره الالكتروني، تطبيقاً لأحكام هذه الاتفاقية، ولما في هذا التنظيم من مصالح قانونية واقتصادية وتجارية وتنظيمية.

المادة التاسعة – الملكية الفكرية:

1- إن حقوق الملكية الفكرية الخاصة بالمتجر هي حقوق مملوكة للمتجر ملكية تامة، سواءً كانت مملوكة لهم قبل تأسيس هذه المنصة الالكترونية أم بعد تأسيسها.

2- يحترم المستهلك أو المستهلك حقوق الملكية الفكرية الخاصة بالمتجر، والتي من ضمنها اسم المتجر نفسه، والكلمات والشعارات والرموز الأخرى الخاصة بالمتجر أو المعروضة عليه، حيث أن كل حق يتبع باسم المتجر هي حقوق مملوكة ملكية فكرية كاملة للمتمجر

المادة العاشرة - مسؤولية المتجر:

1- يلتزم المتجر بأن يمارس عمله التجاري عبر هذه المنصة الالكترونية بشكل نظامي ووفقاً للأنظمة المعمول بها في المملكة العربية السعودية، ووفقاً لأحكام هذه الاتفاقية.

2- المتجر لا يتحمل أي مطالبات تنشأ عن أخطاء أو إهمال ، سواء كانت ناتجة بشكل مباشر أو غير مباشر أو اعرضي أو عن طريق المستهلك أو عن طريق طرف ثالث مثل شركات الشحن.

3- يلتزم ( اسم المتجر ) ومنسوبيها ومُلّاكها ومن يمثّلهم بأن يكون ( المنتج أو الخدمة ) سليمة و شرعية و مصرح به وفق قوانين وأنظمة المملكة العربية السعودية ويتم استخدامه لاغراض شرعية.

المادة الحادية عشر - تقييد الولوج أو العضوية:

يمكن للمتجر وقف أو إلغاء عضوية المستهلك أو تقييد ولوج المستهلك إلى خدمات المنصة في أي وقت وبدون إنذار ولأي سبب، ودون تحديد.

المادة الثانية عشر - القانون أو النظام الواجب التطبيق:

اتفاقية الاستخدام هذه محكومة ومصاغة بحسب القوانين والأنظمة والتشريعات المعمول بها والسارية في المملكة العربية السعودية ، وهي خاضعة تمامًا وكليًا للأنظمة المعمول بها لدى السلطات في المملكة العربية السعودية.

المادة الثالثة عشر- أحكام عامة:

في حال إلغاء أي مادة واردة أو بند ورد في اتفاقية الإستخدام هذه أو أن هناك أي مادة واردة أو أي بند وارد في إتفاقية الإستخدام لم يعد نافذًا ، فإن مثل هذا الأمر لا يلغي صلاحية باقي المواد والبنود والأحكام الواردة في إتفاقية الإستخدام وتظل سارية حتى إشعار آخر من إدارة المتجر

إتفاقية الإستخدام هذه - والتي قد تعدل بين حين وآخر بحسب مقتضى الحال - تُشكّل إتفاقية الإستخدام وآلية العمل والتفاهم والاتفاق والتعاقد بين المتجر وبين المستهلك ، كما يوافق كلا أطراف هذه الاتفاقية على أن يوضع في عين الاعتبار ما يلي:

1- إن اللغة العربية هي اللغة المعمول بها عند تفسير أحكام هذه الاتفاقية، أو عند ترجمتها إلى لغة أخرى.

2- إن جميع الأسعار المعروضة على خدمات أو منتجات المتجر قد تعدّل بين حينٍ وآخر.

3- إن العروض الترويجية أو التسويقية التي قد يضعها المتجر هي عروض مؤقتة، حيث أنه للمتجر الحق في تعديل هذه العروض الترويجية أو التسويقية في أي وقت أو إيقافها.

4- يلتزم أطراف هذه الاتفاقية بالتعامل فيما بينهم بما لا يخالف القواعد الشرعية والأنظمة والقوانين المعمول بها ذات العلاقة بطبيعة التعامل بين المتجر والمستهلك.

5- لا تُلغى اتفاقية الاستخدام هذه إلا بموجب قرار يصدر من إدارة المتجر

Terms of Use Agreement

Introduction

Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal effects resulting from your use of the store’s services through this electronic platform. Any use of the store by any person, whether as a consumer of the store’s services or products or otherwise, constitutes acceptance and approval of all terms and conditions of this agreement while possessing full legal capacity under Sharia, regulations, and applicable laws. Such use confirms your commitment to comply with these terms and conditions.

This agreement applies to all transactions between the consumer and the store. This agreement shall become effective and binding immediately upon your acceptance and commencement of registration with the store in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 – Introduction and Definitions

The above introduction is an integral part of this agreement. The following terms and expressions shall have the meanings assigned to them below:

1. (Store): Refers to all forms of the store on the internet, including electronic applications, websites, or physical commercial establishments.
2. (Consumer): Refers to any person engaging in e-commerce for the purpose of obtaining products or services provided by the store through its electronic platform.
3. (Agreement): Refers to these Terms and Conditions, which govern and regulate the relationship between the parties to this agreement.

Article 2 – Consumer Legal Eligibility

1. The consumer acknowledges that they possess the legal capacity required under Sharia and applicable laws to deal with the store, or that they are at least eighteen (18) years old.
2. The consumer agrees that if they violate this article, they shall bear all consequences arising from such violation before third parties.

Article 3 – Nature of Commitment

1. The store’s obligation toward consumers is to provide the requested service or product.
2. The store may provide additional services such as after-sales services or related services depending on the nature and type of the requested service or product.

Article 4 – Rules of Use

1. The consumer agrees to use the store’s electronic platform in accordance with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
2. The consumer agrees not to use any product or service purchased from the store in any manner that violates public morals or the laws and regulations applicable in the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations

Upon applying for membership in this store as a user, you are required to provide specific information and choose a username and confidential password for accessing the store’s services. By doing so, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the store of any unauthorized use of your account or any breach of your confidential information.
2. The store shall not, under any circumstances, be liable for any direct or indirect loss, whether material or moral, resulting from the disclosure of the consumer’s username or password.
3. You agree to use your account personally and acknowledge full responsibility for it. Any use of your account by others shall be deemed as authorization granted by you for such use.
4. You agree to use the store seriously and honestly.
5. You agree to provide true, accurate, current, complete, and lawful information about yourself during registration and to update such information whenever necessary.
6. The store is committed to handling your personal information and contact details with complete confidentiality.
7. If the store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or agreement-violating information, the store shall have the right to suspend, freeze, or cancel your membership or account without prejudice to the store’s other rights and lawful remedies.
8. In case of non-compliance with any of the above obligations, the store administration has the right to suspend or cancel your membership or deny you access to the store’s services again.

Article 6 – Electronic Communications and Official Means of Communication

1. The parties to this agreement agree that communication shall be conducted through the email address registered on the platform.
2. The consumer agrees that all electronic agreements, notices, statements, and communications shall have the same legal effect as written documents and shall constitute valid evidence in fulfilling legal and Sharia requirements.
3. The consumer agrees that the store administration may communicate with them regarding any provisions related to this agreement or their dealings with the store through general announcements sent to all consumers or specific users.

Article 7 – Amendments to the Terms of Use and Fees

1. If any provision or clause of this agreement is canceled or becomes unenforceable, such cancellation shall not affect the validity of the remaining provisions, clauses, and terms, which shall remain effective until further notice from the store administration.
2. This agreement, as amended from time to time, constitutes the mechanism of operation, understanding, and agreement between the consumer and the store.
3. The store may impose fees on certain consumers depending on offers, products, services, or taxes and governmental charges related to the nature of the product or service.
4. The store reserves the right to add, increase, reduce, or deduct any fees or expenses under this agreement for any consumer regardless of the reason for registration.

Article 8 – Payment Services

1. The store, through its partners, provides payment systems through available online payment methods or any payment methods introduced by the store from time to time.
2. The store is committed to setting the price of products or services according to recognized market value.
3. The store is committed to issuing invoices, payment receipts, and delivery receipts for all transactions and profits generated through the store and shall provide the consumer with an invoice for purchased products or services.
4. The store shall comply with recognized accounting standards applicable to its electronic store in accordance with this agreement and relevant legal, economic, commercial, and regulatory interests.

Article 9 – Intellectual Property

1. All intellectual property rights related to the store are fully owned by the store, whether owned before or after the establishment of this electronic platform.
2. The consumer agrees to respect the intellectual property rights of the store, including the store name, logos, symbols, and other trademarks displayed by the store, all of which are fully protected intellectual property rights owned by the store.

Article 10 – Store Liability

1. The store undertakes to conduct its business through this electronic platform in compliance with the applicable laws and regulations of the Kingdom of Saudi Arabia and in accordance with this agreement.
2. The store shall not be liable for any claims arising from errors or negligence, whether direct, indirect, incidental, or caused by the consumer or third parties such as shipping companies.
3. The store, its employees, owners, and representatives undertake that the products or services provided are lawful, authorized, and compliant with the laws and regulations of the Kingdom of Saudi Arabia and are used for legitimate purposes.

Article 11 – Restriction of Access or Membership

The store may suspend, cancel, or restrict the consumer’s access to the platform’s services at any time, without prior notice and for any reason whatsoever.

Article 12 – Governing Law

This Terms of Use Agreement shall be governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and shall be fully subject to the jurisdiction of the competent authorities in the Kingdom of Saudi Arabia.

Article 13 – General Provisions

If any provision or clause of this agreement becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in effect until further notice from the store administration.

This Terms of Use Agreement, as amended from time to time, constitutes the entire agreement governing the relationship, understanding, and contractual arrangement between the store and the consumer. Both parties agree to the following:

1. The Arabic language shall be the official language used in interpreting the provisions of this agreement or translating it into any other language.
2. All prices displayed for products or services may be modified from time to time.
3. Promotional and marketing offers provided by the store are temporary, and the store reserves the right to modify or discontinue such offers at any time.
4. Both parties agree to deal with each other in accordance with Sharia principles and applicable laws and regulations governing the relationship between the store and the consumer.
5. This agreement may only be terminated by a decision issued by the store administration.
